These Terms of Service ("Terms") govern your use of binaryphp.com, the BinaryPHP encoder service, and the BinaryPHP loader extension (collectively, the "Service"), provided by Taiwan Telecom, Inc. ("we", "us", "the Company"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
BinaryPHP is a software service that encrypts PHP source files and embeds licensing metadata (domain restrictions, MAC binding, expiration dates). The Service consists of:

files and .zip archives;libbinaryphp.so) that decrypts files at runtime.You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. By signing in you represent that any information you provide is accurate and that you have the right to use the email address associated with your Google account.
You are responsible for activity occurring under your account. If you suspect unauthorized use, notify us immediately by opening a ticket via our contact form.

We may suspend or terminate accounts that violate these rules without prior notice.
You retain all ownership and intellectual property rights in code you upload to the Service. We claim no rights, title, or interest in your source code. We will not view, copy, redistribute, or use your uploaded files for any purpose other than processing your encoding request.
The encoded files we produce are derivatives of your input. They are yours to redistribute, sell, modify, and re-encode without restriction from us.
The BinaryPHP loader binary, the website, the encoder service code, the file format specification, and all related branding are the property of BinaryPHP and its licensors. The loader binary is free to redistribute alongside encoded files; the SaaS encoder backend is not licensed for redistribution.
The Service is offered in three tiers:

one licensed domain or MAC, rate-limited to 6 encodes per minute per IP..zip uploads up to 10 MB,
up to 50 licensed domains/MACs, 60 encodes per minute..zip uploads up to 100 MB,
up to 500 licensed domains/MACs, 600 encodes per minute, priority support.Paid subscriptions are billed annually in advance. Renewal is automatic unless cancelled. We use Stripe as our payment processor. You may cancel auto-renewal at any time from your account dashboard.
We offer a 30-day refund policy: if you are not satisfied within 30 days of your initial purchase or annual renewal, contact us for a full refund. Pro-rated refunds outside this window are at our discretion.
We may change prices for new subscriptions at any time. Existing subscribers will be notified at least 30 days before any price change affects their renewal.
The BinaryPHP loader (libbinaryphp.so) is provided free
of charge under a redistributable license. You may distribute it
alongside your encoded plugins to your customers. You may not modify,
rebrand, or sell the loader as a standalone product.
The loader is provided "AS IS." See the disclaimer in section 8.
We aim for high availability but do not guarantee uptime. Maintenance, outages, and changes happen. For Enterprise subscribers, see your separate Service Level Agreement. For Free and Pro tiers, the Service is offered on a best-effort basis.
The service is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that the encryption is unbreakable against all possible adversaries. Code protection is a layered defense — for high-value secrets, additional measures (server-side execution, hardware security modules) are recommended.
To the maximum extent permitted by law, BinaryPHP and its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising from your use or inability to use the Service.
Our aggregate liability for any claim related to the Service is limited to the greater of $100 USD or the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold BinaryPHP harmless from any claim arising out of your violation of these Terms, your use of the Service, or your infringement of third-party rights.
You may close your account at any time. We may suspend or terminate accounts that violate these Terms. On termination, your right to access the Service ends; previously-encoded files remain functional indefinitely (the loader has no online dependency for already-issued licenses).
We may update these Terms from time to time. Material changes will be announced by email and on the website at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
These Terms are governed by the laws of Taiwan (R.O.C.), without regard to conflict-of-law rules. Disputes shall be resolved in the Taipei District Court, unless local consumer-protection law in your jurisdiction provides otherwise.
If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full effect.
